GENERAL CONDITIONS FOR USING THE ALTEN BELGIUM WEBSITE

GENERAL POINTS

The general conditions set out below govern the use and consultation of the website belonging to SPRL ALTEN BELGIUM (hereinafter ‘ALTEN BELGIUM’), domain names: www.alten.be, www.axen.be and www.altenbenelux.net as well as all other websites that ALTEN BELGIUM may develop in the future (hereinafter the ‘WEBSITE’).

By consulting and using the WEBSITE, the user (hereinafter the ‘USER’) unreservedly accepts these general conditions of use for the WEBSITE (hereinafter ‘the GENERAL CONDITIONS’) and undertakes to respect them. THE USER is therefore invited to consult and read the GENERAL CONDITIONS.

ALTEN BELGIUM reserves the right to modify the content of the GENERAL CONDITIONS at any time, without issuing prior notice to THE USER.

The invalidity, absence of executory force of or impossibility of being sanctioned by a clause in the GENERAL CONDITIONS do not form an obstacle to the validity, executory force of or the possibility of being sanctioned by the GENERAL CONDITIONS, except if the GENERAL CONDITIONS are no longer applicable without this clause.

The architecture and content of the WEBSITE were created and developed and are managed by SPRL ALTEN BELGIUM, whose registered office is located at 92, Gulledelle, 1200 BRUSSELS, Belgium, intra-Community VAT number BE 471960230, company number 0471.960.230, RPM BRUSSELS.

ACCESS TO THE WEBSITE

ALTEN BELGIUM undertakes, to a reasonable extent, to allow access to the WEBSITE 24 hours per day and 7 days per week.

However, access to the WEBSITE can be interrupted for reasons of force majeure, technical reasons or for maintenance of the WEBSITE. ALTEN BELGIUM does not offer any guarantee of whatsoever nature, in the event of an interruption of access to the WEBSITE or a section of it.

INTELLECTUAL PROPERTY

The WEBSITE, its architecture, its software, its content, its texts, its drawings, its logos, its presentation, its lay-out as well as generally speaking all of the technical, computer, graphical or literary features reproduced in the WEBSITE (hereinafter the ‘PROTECTED ELEMENTS’) are protected by national provisions on intellectual property, especially the provisions on copyright and related rights, sui generis law on databases, trademark law, drawings and models rights and patent law.

Furthermore, the names AXEN, ALTEN, ALTEN BELGIUM, ALTEN TECHNOLOGY and ALTEN IT SOLUTIONS as well as the logos AXEN and ALTEN have been registered as BENELUX trademarks with the BENELUX INTELLECTUAL PROPERTY OFFICE and as Community trademark with the EUROPEAN INTELLECTUAL PROPERTY OFFICE.

As a result, THE USER cannot, without prior written consent from ALTEN BELGIUM and the holders of the intellectual property rights mentioned above, use, modify, disseminate, market, reproduce, copy, publish, translate, transfer, sell or license the PROTECTED ELEMENTS or develop derived works and products, in full or partially, from the PROTECTED ELEMENTS.

Any violation of this clause will be sanctioned by civil and/or criminal proceedings in compliance with the applicable national and international provisions.

HYPERLINKS

The WEBSITE can contain hyperlinks to third party websites. These are solely reproduced for THE USER’s information. ALTEN BELGIUM cannot verify the content of these websites and cannot be held liable under any circumstances for the existence of these websites, nor the information contained in them. Furthermore, the existence of these links does not mean that ALTEN BELGIUM approves of the content of these websites or that it collaborates in any way whatsoever with the operators of these websites.

THE USER’S OBLIGATIONS

THE USER undertakes not to use the WEBSITE or its content for illegal purposes or purposes which harm ALTEN BELGIUM or third parties, not to use the WEBSITE to transmit or distribute computer viruses or harmful or illegal information, not to hamper access to the WEBSITE, or to disturb or modify the WEBSITE or furthermore to make it less functional or to cause harm to the WEBSITE, ALTEN BELGIUM or third parties, not to compromise intellectual property rights present on the Website and not to forward or transmit any unsolicited message (‘spam’).

ALTEN BELGIUM reserves the right to report THE USER who infringes the applicable national or international provisions to the competent authorities and to suspend access to and use of the services and data for an indeterminate period in the case of any USER who violates or does not respect the GENERAL CONDITIONS.

RESPECT FOR THE USER’S PRIVACY

ALTEN BELGIUM may be led to register personal data communicated to it via the WEBSITE (surnames, first names, addresses, curriculum vitae, etc.) in databases which it owns. This data can be registered by ALTEN Belgium and used for purposes of prospecting, sales activity promotions, actual sales activities, for the provision and invoicing of services, for management and information purposes, to process requests made via the WEBSITE (notably in the recruitment area), as well as for the purposes of market studies, marketing and to offer other services.

ALTEN BELGIUM is likely to call on third parties to carry out market studies or marketing actions or direct marketing or for the provision of certain services in the context of subcontracting or cooperation contracts. ALTEN BELGIUM communicates personal data which is supplied to it via the Website to third parties solely insofar as this proves to be necessary for the execution of tasks entrusted to them and exclusively for the purposes of this execution.

APPLICABLE LAW AND COMPETENT COURT

Any dispute relating to the WEBSITE, its content or its use is governed exclusively by Belgian law, to the exclusion of rules of international law and private law which refer to foreign law, and shall be subject to the exclusive competency of the courts of the judicial arrondissement of BRUSSELS, BELGIUM. The use and consultation of the WEBSITE are not authorised in countries which do not apply all of these provisions, including the present paragraph.
